Hello and welcome! These Terms of Service (“terms” or “TOS”) are an agreement formed between you (“you”) and Tenebrous Tales Interactive (“company,” “TTI,” “we” or “us”). These terms cover the website available at ttalesinteractive.com (the “website”), the related applications (the “app”, “game”, or “front end”), and any content, tools, features, and functionality offered on or through our Website and App (collectively, the “services”).
By accessing and/or using our services, you agree to these terms. Please read them carefully as they include important information about your legal rights. If you don’t understand or agree to these terms, please refrain from using our services.
For purposes of these terms, “you” refers to both individual users as well as entities representing those users. If you use our services on behalf of a company or other entity then “you” includes both yourself and that entity. By agreeing to these terms on behalf of an entity, you represent that you have authority to bind such entity.
Please note that any disputes with us will be resolved through binding individual arbitration rather than traditional court proceedings. Additionally, by accepting these terms, you waive your right to participate in class actions or representative actions.
Use of Our Services:
General Acess: We do not recommend our services for anyone under the age of 16. For residents in the United States, users must be at least 13 years old; European Union residents must be 16 years or older due to legal requirements.
GDRP Requests: We prioritize user privacy and comply with all applicable data protection laws, including the General Data Protection Regulation (GDPR). Please note that we do not collect personal information directly from our users – such data should be requested via API through our host platform if necessary.
Registration Obligations: To access certain features of our services, you may need to complete a registration form through a third party to purchase access.
Member Account Security: You are responsible for maintaining confidentiality regarding your account credentials, API keys, chat logs, and character data.
Modifications: We reserve the right to modify or discontinue any part of our services temporarily or permanently without notice.
General Practices Regarding Use & Storage: Please refer to our privacy policy here, we do not ascribe to any form of data collection while using the front end.
Third-Party Websites & Services: Our services may provide access to third-party sites or applications, but we are not responsible for their content or any resulting damages.
Indemnity and Release:
You agree to release, indemnify, and hold Tenebrous Tales Interactive (TTI), (its affiliates, directors, officers, employees, agents, licensors, or partners) harmless from any claims or demands made by any third party due to or arising out of your use of our services or your violation of these terms. You further agree to defend TTI against any such claims at your own expense.
In no event shall TTI be liable for any indirect, incidental, or special consequential damages including but not limited to: loss of profits, or bodily harm (up to and including actions that may result in death) caused by the use of our services. You acknowledge that you are using the services at your own risk and that we provide them on an “as is” basis without warranties or guarantees of any kind.
